Website Terms & Conditions & Important Information

BAU Risk Services Pty Ltd (Insurance Brokerage)

1. About these Website Terms

These Website Terms & Conditions (“Terms”) apply to your use of insurancebrokerage.au (the “Website”). By accessing or using the Website, you agree to these Terms.

These Terms cover Website use and general information available on the Website.
If you become a client and ask us to arrange insurance or provide insurance broking services, we will also provide you with (and you will be covered by) our Financial Services Guide (FSG) and other disclosure documents (including Terms of Engagement where applicable).

2. Who we are (licensing and regulatory disclosure)

BAU Risk Services Pty Ltd (ABN 98 674 136 988) trading as BAU Risk Services (“BAU”, “we”, “us”, “our”).

BAU Risk Services Pty Ltd is a Corporate Authorised Representative (CAR No. 001308013) of:
Apollo Risk Services Pty Ltd (ABN 60 367 225 615) trading as Apollo Risk Services, AFSL 403727 (“Apollo”).

Apollo is responsible for the financial services BAU provides to you under Apollo’s Australian Financial Services Licence.

3. General information only (no personal advice warning)

Information on this Website is provided for general information purposes and may be general advice. It does not take into account your objectives, financial situation or needs.

Before acting on any information on this Website, you should consider whether it is appropriate for you and consider relevant disclosure documents such as the FSG and the Product Disclosure Statement (PDS) (where applicable).

4. No offer, guarantee or binding cover

Nothing on this Website constitutes an offer of insurance or a guarantee of cover, terms, or premium. Insurance is subject to insurer acceptance, underwriting criteria, policy terms, conditions, exclusions, and any applicable premium adjustments.

5. Insurance broking role and how we act

Where BAU provides general insurance broking services, we generally act on your behalf as an insurance broker unless we tell you otherwise.

In some situations, insurance may be arranged under a binder/agency arrangement held by Apollo. In those cases, we may be acting as the agent of the insurer (meaning we represent the insurer, not you). We will tell you if this applies.

6. Remuneration and “not independent” notice

We (and/or Apollo) may receive remuneration such as commission and/or other benefits when arranging insurance or providing advice. We may also charge fees. Because of this, we (and/or Apollo) are not independent, impartial, or unbiased within the meaning of the Corporations Act. Further detail is set out in the FSG.

7. Accuracy of Website content

We try to keep Website content accurate and up to date. However, the Website content:

may not cover all aspects of relevant law or insurance practice, and

may not be complete, current or suitable for your particular needs.

You should obtain professional advice before acting on Website content and verify any information you intend to rely on.

8. Acceptable use of the Website

You agree that you will not:

use the Website for unlawful purposes;

interfere with the security or operation of the Website;

attempt to gain unauthorised access to Website systems; or

upload, transmit or distribute malicious code (including viruses).

We may suspend or restrict access to the Website where we reasonably believe misuse has occurred.

9. Intellectual property

Unless otherwise indicated, we (or our licensors) own the intellectual property in the Website content (including text, logos, graphics and layout). You may view and print content for your personal/internal business use, but you must not reproduce, publish, modify or distribute Website content without our prior written permission (except as permitted by law).

10. Third-party links

The Website may contain links to third-party websites. Those sites are not controlled by us and we are not responsible for their content, availability, security, or privacy practices. Linking does not imply endorsement.

11. Privacy and personal information

We are committed to protecting your privacy and handling personal information in accordance with applicable Australian privacy laws. Our privacy practices (including the collection, use and disclosure of information to insurers, intermediaries, and service providers—including in some circumstances overseas—where required to arrange insurance and related services) are described in our privacy disclosures.

Marketing and opt-out: We may send you information we believe may be of interest (e.g., updates, services, renewals). You can opt out of marketing communications by contacting us.

12. Cookies and analytics

We may collect anonymous statistical information about how the Website is used (e.g., time/date of visit, pages viewed, browser type) to improve Website functionality and services. We may use cookies for this purpose. You can usually disable cookies via your browser settings, but parts of the Website may not function correctly.

13. Security of online communications

While we take reasonable steps to protect information, internet communications are not always secure.

If you submit information via Website forms, that information may be transmitted via email or other systems and may not be encrypted end-to-end. If you are concerned about confidentiality, contact us to discuss alternative ways to provide information.

14. Disclaimer and limitation of liability

To the extent permitted by law:

the Website and its content are provided “as is” without warranties of any kind (express or implied); and

we are not liable for loss or damage arising from your use of, or inability to use, the Website or reliance on its content (including loss arising from errors, omissions, interruptions, delays, defects, or malicious code).

Nothing in these Terms excludes any rights or remedies you may have under the Australian Consumer Law or other applicable laws that cannot be excluded.

15. Complaints and dispute resolution

We aim to resolve complaints promptly and fairly.

Step 1 – Talk to your representative:
If you are unhappy with a product or service, please first contact the BAU representative you have been dealing with.

Step 2 – Escalate to Complaints Officer:
If unresolved, you can escalate the complaint to the Complaints Officer (as set out in Apollo’s complaints process). Apollo’s published process indicates complaints are acknowledged and handled with an aim to resolve within 30 calendar days.

Step 3 – External dispute resolution (AFCA):
If you are not satisfied with the outcome, you can contact the Australian Financial Complaints Authority (AFCA), an independent and free service.

16. Changes to these Terms

We may update these Terms from time to time by publishing the updated version on this page. Your continued use of the Website after changes are published means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of Australia and the state/territory in which we are principally located, and you submit to the non-exclusive jurisdiction of the courts of that place.
